This may well fall under number five, since "...you know?" and "...do you know that?" do not seem to be that different.
Perhaps we can make a case for it in the future. :>

I think the difference is that "Do you know that?" is a new sentence whereas ", you know" is a bit like an afterthought. I think if the second part can stand alone as a sentence on its own (as the second part of the above sentence can) then it should be a new sentence.

I agree comma splice rules are open to interpretation and I would welcome any grammarians' comments on this.
