Any resolution on the possible copyright violation status?

Dorenda Dorenda June 12, 2011 June 12, 2011 at 7:03:11 PM UTC flag Report link Permalink

How about removing the second sentence? The first sounds common enough for me not to violate any copyright.

Swift Swift June 12, 2011 June 12, 2011 at 7:25:34 PM UTC flag Report link Permalink

What is this a possible copyright violation of?

Dorenda Dorenda June 12, 2011 June 12, 2011 at 7:27:20 PM UTC flag Report link Permalink

It's from a song.

Swift Swift June 12, 2011 June 12, 2011 at 7:31:58 PM UTC flag Report link Permalink

Sure, either that and change the translations, or just delete it and ask the others to add their translations to that (whichever you think is less work/cleanest).

Copyright exists to make sure that the creators of original content can make revenues without third persons interfering with that.

A short two-sentence segment from a song cannot in any way interfere with the creator's intent to make revenues from his creations. It's actually even likely that displaying the sentence and noting the source could create additional interest in the song.

So removing the second part sounds like copyright paranoia to me.

We had this debate before and even short excerpts from songs are not acceptable. That being said, if the sentence is really generic then it might be ok.

slomox slomox June 13, 2011 June 13, 2011 at 6:54:12 PM UTC flag Report link Permalink

But _why_ are they not acceptable? What would the harm be?

And apart from that I do believe that "Just so you know that." is a generic sentence.

This sentence was added by Dorenda, as was the tag. Presumably she took this from the song rather than just happen to come up with it independently and notice the similarity after the fact. The song author doesn't have sole rights to the sentence, but they are protected from having their works used directly.

Individual sentences would arguably not be a breach of copyright. Nor would distributing small notes with a single sentence from a copyrighted novel, or even a whole batch of bits of that novel. This is why one can legally offer Bittorrents -- the illegal act isn't to distribute or download the bits, but to assemble them into the copyrighted work.

So why can't we do the same. Well, I guess we could. But not only would it be a somewhat legally grey area, it is a morally grey area and the question you should ask is: Why are they necessary?

If they're so hip and cool and catchy, then really we should let the authors reap the benefits of their toil. If one just wants to illustrate a grammatical point or vocabulary usage, then it'd be best to just come up with an original sentence of one's own.
