Ich finde, der Selbe ist hier richtig. Ich habe ja nicht geschrieben "...derselbe Mensch".

Ich glaube, es gibt keinen Beleg dafür, dass man "der Selbe" je groß und auseinander schreiben darf, auch wenn es substantiviert ist. Wahrscheinlich steckt keine besondere Logik dahinter, es ist einfach so festgelegt worden.
