Il s'agit d'un subjonctif.
Il exprime ici une improbabilité.
Un roi parlerait ainsi.
Ici, c'est Charles 1er d'Angleterre qui parle.
En effet, la loi émanant du Roi, le Roi ne saurait être délinquant.
Savoir cette délinquance de sa part est donc totalement improbable, ce qui justifie le subjonctif.

Après "je ne sache pas", on trouve plus couramment "que" ou l'infinitif.

Je ne sache pas que jusqu’à présent, on eût jamais vu en France, sous la monarchie légitime, des chambres, des ministres responsables, un budget

Non, je ne sache pas avoir, dans le reste des Pyrénées, franchi de pas plus difficile

Mais je ne sache pas qu'ça profite à ces drôles
De jouer le jeu d'l'amour en inversant les rôles (Brassens)
